Managing the Dark Side of Clean Energy: Legal and Policy Challenges of Solar E-Waste in India
Solar E-Waste, E-Waste (Management) Rules, 2022, Environment
Over the past decade, India has rapidly expanded its solar energy sector to achieve its climate and Sustainable Development Goals (SDGs), to shift towards renewable energy, and to strengthen energy independence. However, with the increase in the installation of solar panels, the risk of managing waste generated by these solar panels increases. Therefore, it is important to have dedicated regulations for solar waste. Which not only mandates its environmentally sound dismantling and recycling but also holds producers legally responsible for the safe disposal of solar e-waste. Earlier, India did not have regulations that specifically cover solar PV waste, but the E-Waste (Management) Rules, 2022, formally include solar modules, panels, and cells. Despite these developments, some gaps still exist. In this paper, I have analysed the effectiveness of India’s current regulatory framework, particularly the E-Waste (Management) Rules, 2022. The paper has also identified the key challenges for the implementation of such rules.
