In the rapidly evolving digital landscape, India faces unprecedented challenges in the realms of cybercrime, data breaches, and cybersecurity. This dissertation investigates the growing complexities of cyber threats and critically evaluates the adequacy of India’s current legal, institutional, and technological frameworks. With the exponential growth in internet usage, mobile penetration, and digital transactions, the country has witnessed a sharp surge in cybercrimes ranging from financial frauds and identity thefts to state-sponsored cyber espionage and ransomware attacks.
The study delves deep into the Information Technology Act, 2000 and the recently enacted Digital Personal Data Protection Act, 2023, examining their efficacy in addressing emerging digital threats. A detailed review of case laws such as Justice K.S. Puttaswamy v. Union of India, Bhima Koregaon surveillance case, and Air India data breach provide a jurisprudential lens to assess privacy, surveillance, and data protection issues in India.
Furthermore, the dissertation presents a comparative analysis of global data protection laws such as the GDPR (EU), CCPA (California), and China's Personal Information Protection Law, highlighting the gaps and opportunities in India's cybersecurity approach. It also explores the roles of regulatory bodies like CERT-In, I4C, and the proposed Data Protection Board of India.
The findings suggest that while India has made significant strides in digital infrastructure and cybersecurity awareness, it still lacks a cohesive legal framework, robust enforcement mechanisms, and international cooperation necessary to tackle transnational cyber threats. The dissertation concludes with a set of targeted legal, policy, and institutional reforms and a roadmap toward a cyber-resilient India.
