Comparative Legal Frameworks for E-Contracts: India vs Global Standards
E-commerce , E-contracts, legal framework
The emergence of the digital economy has revolutionized how contracts are formed, executed, and enforced. Electronic contracts (e-contracts) are now a cornerstone of global commerce, enabling faster, borderless, and more efficient transactions. These contracts, formed through digital platforms using various technologies, raise new legal and regulatory challenges regarding authenticity, enforceability, data privacy, and jurisdiction. This research paper provides a detailed comparative analysis of the legal frameworks governing e-contracts in India, the United States, the European Union, Australia, and Singapore. It examines how each jurisdiction recognizes electronic signatures, regulates electronic records, and resolves cross-border disputes. Additionally, the paper explores the influence of the UNCITRAL Model Law on Electronic Commerce (1996) in harmonizing global standards. By analyzing similarities and divergences across jurisdictions, the study identifies critical gaps in the Indian legal framework, particularly in terms of enforceability, privacy protection, and international interoperability. The paper concludes by proposing legal reforms and policy recommendations aimed at strengthening India’s digital legal infrastructure to align with international best practices and foster a legally secure environment for digital transactions.
