Marital rape, a heinous violation of human dignity and bodily autonomy, remains one of the most underreported and misunderstood crimes globally. It is rooted in patriarchal norms that deny women their right to consent within marriage, perpetuating a culture of silence and impunity. While the United States has made significant strides in criminalizing marital rape and supporting survivors, India continues to grapple with outdated laws that shield perpetrators under the guise of marital rights. This paper undertakes an exhaustive comparative analysis of marital rape in India and the United States, focusing on their legal frameworks, societal attitudes, cultural barriers, and survivor support systems. By exposing these disparities, this study underscores the urgent need for legal reform, societal awareness, and survivor-centric policies to address this pervasive issue.
Marital rape, the act of sexual intercourse with one's spouse without their consent, has historically been a contentious legal and socio-cultural issue globally. This paper undertakes a comparative study of the legal framework, socio-cultural perceptions, and advocacy surrounding marital rape in India and the United States. While both nations have witnessed significant advancements in women's rights, their approaches to criminalizing or addressing marital rape diverge considerably.
This research explores the historical evolution of marital rape laws, analyses the legal arguments for and against criminalization, examines the prevalence and impact of marital rape on victims, and evaluates the role of societal attitudes in shaping legal reforms and access to justice. Ultimately, the paper aims to highlight the challenges and opportunities for achieving legal recognition and addressing the social stigma surrounding marital rape in both India and the USA, contributing to a broader understanding of this critical issue in the context of gender equality and human rights.
