EVIDENTIARY VALUE OF DYING DECLARATION: AN ANALYTIC STUDY
Dying Declaration, Evidence Law, Hearsay Exception, Criminal Jurisprudence, Admissibility.
The dying declaration is a crucial item of evidence in criminal law, especially in cases of homicide, where the last statement of the victim will usually be the main evidence for the crime. Based on the legal principle "Nemo moriturus praesumitur mentiri" (no one who is about to die will be presumed to lie), it is held to be highly trustworthy. This article analyses the legal framework, judicial constructions, conditions of admissibility, and issues related to dying declarations in various jurisdictions. It also discusses the weightage accorded to such statements as evidence and proposes reforms to make them more credible.
