India's history of regulating firearms is complex, influenced by both colonial and modern security concerns. With an emphasis on the Arms Act of 1959, this research paper aims to examine the evolution, implications and implementation of arms laws in India. This paper has emphasized on the distinct goals of the laws passed by the Indian and British governments, respectively, when analysing the development of the laws pertaining to gun control in India. This study highlights the government's main objective in passing the Arms Act of 1959, which was to control access to and use of firearms and ammunition in order to maintain public safety and order. The legal definitions of weapons and ammunition, the judicial interpretations of pertinent cases, and the social effects of arms proliferation are all examined in this paper. It highlights the key distinctions between different kinds of weapons, including toy guns and firearms, and looks at notable court rulings that have shaped how the law is interpreted. In view of growing worries about terrorism and national security, the report emphasizes the legislature's commitment to preventing illegal access to weapons. It also examines the legal repercussions of owning unauthorized firearms as well as the evidentiary requirements for classifying an object as a "arm". The difficulties in enforcing the law and the need for more stringent rules to protect public safety are also covered in the report. The paper seeks to provide clarity on the legal framework controlling arms in India by thoroughly examining case law and statutory regulations, fostering a better understanding of the implications.
